PARTIES

The Parties are Fundación de la Universidad de Cantabria para el Estudio y la Investigación del Sector Financiero (The University of Cantabria Foundation for Studies and Research on the Financial Sector) (hereinafter UCEIF); with tax registration number G39622360; with registered office Edificio Rectorado, Avda. de los Castros s/n 39006 Santander (Cantabria); email formacion@sanfi.es.

And the Student, who is the person purchasing the training services available at the Internet address www.sanfi.es (hereinafter, the Web Page).

SCOPE

The training services provided through the website shall be understood to be intended solely and exclusively for the Student purchasing them, and may not be transferred by the latter to third parties, nor be used by persons other than the Student, unless expressly authorized to do so in writing by UCEIF.

Purchasing the training services available on the Website, implies the express acceptance by the Student of all the clauses of these general conditions of purchasing, as well as the particular conditions contained for each of the courses available on the Website. In the event of not accepting any of the aforementioned clauses, the Student must refrain from purchasing services on the Website.

The purchase shall not be considered as finalised, nor shall it imply any rights in favour of the student, until the price has been paid in full. On the other hand, UCEIF reserves the right not to accept applications, and shall inform the Student via email in such cases, and reimburse the price paid.

In the event of any contradiction between these general purchasing conditions and the particular conditions, the provisions of the particular conditions shall prevail in all cases.

Students who pay on the Website using Banco Santander’s Virtual POS, automatically accept the Bank’s legal agreements for payment services.

The general and particular conditions may be modified at any time, so it is up to the Student to review them before purchasing the services available on the Website.

DURATION OF THE CONTRACT

The duration of this contract shall be the same as the expected duration described in the particular conditions of each course. The Student expressly accepts the start and end dates and times, for each edition of the course. During that period of time, UCEIF shall grant the Student access to the digital contents of the course via the Internet. Once the term has elapsed, it shall be understood that UCEIF has fulfilled its contract with the Student, regardless of whether or not the Student accesses the course.

However, if for reasons of force majeure beyond the control of UCEIF, the service has to be suspended, UCEIF shall notify the student with thirty days’ notice, and shall reimburse the student the proportional part of all amounts already paid that cover services not yet delivered.

LANGUAGE AND TERRITORY

These general purchasing conditions are written exclusively in Spanish.

Purchase of the services available on the Website is offered exclusively to the territory of Spain.

The training services shall be provided in the language indicated in each case and where no language is mentioned they shall be provided in Spanish.

METHOD OF PAYMENT AND SECURITY OF TRANSACTIONS

The following payment methods are allowed for purchasing products or services available on the Website:

We guarantee that each of the transactions carried out in UCEIF is 100% secure. All operations involving the transmission of personal or banking data are carried out using a secure environment. UCEIF uses a server based on the standard security technology SSL (Secure Socked Layer). All the information you transmit to us travels encrypted through the network. Likewise, your credit card information is not registered in any database but goes directly to the Bank’s POS (Point of Sale Terminal).

In addition, we hereby inform you that in an effort to provide greater security to credit card owners, we have incorporated the secure payment system called CES (Secure Electronic Commerce) into our payment gateway. In this way, if you are a holder of a “secured” card, you will always be able to make payments with VISA or MASTERCARD in our store. In the event that your card is not a member of this payment system, UCEIF shall only accept payment with VISA or MASTERCARD credit cards from customers with a proven record and reliability. In both cases, when paying with VISA or MASTERCARD, the following data will always be requested: the card number, the expiry date, and a Validation Code that matches the last 3 digits of the number printed in italics on the back of your VISA or MASTERCARD, in order to provide further guarantees about the security of the transaction.

Important: Credit card fraud is a crime, and UCEIF shall take legal action against anyone who makes a fraudulent transaction in our on-line store.

PRICE

The prices applicable to the different courses shall be those that appear on the website, and in the particular conditions of each course, and the prices shall also give a break-down of the shipping costs of materials (if applicable), taxes, and applicable fees.

In the event that UCEIF detects any typographical errors on the Website or in the particular conditions, it shall immediately correct them. If the typographical error refers to prices and the Student has purchased any of them as a consequence of the error, he or she shall be informed immediately and shall have the right to cancel the contract without any cost.

AGE

The minimum age to purchase the training services shall be 18 years old.

WITHDRAWAL

Students who are considered as consumers or users shall have the right to withdraw from the contract during a period of 15 calendar days from the contracting of the course, without giving any reason.

This right of withdrawal shall not apply:

UCEIF shall reimburse any payment received from the Student within 15 calendar days from the date on which the Student informed of the decision to withdraw from the contract.

In the event that teaching material has been sent, UCEIF may withhold reimbursement until the material has been returned and received. The cost of returning the material shall be borne by the Student.

INTELLECTUAL PROPERTY

The intellectual property rights over the documentation generated and the original ideas formulated while providing the Services belong to UCEIF.

Students may use documentation or other media that are provided by UCEIF while providing the training services exclusively for their own use, and they may not distribute them or provide access to other persons other than the Student, without prior express written permission of UCEIF.

PROTECTION OF PERSONAL DATA

In compliance with current regulations on Personal Data Protection, specifically, the General Data Protection Regulation of the European Union (GDPR – EU 679/2016) and the Organic Law 3/2018 of December 5, 2018, on the Protection of Personal Data and Guarantee of Digital Rights, we hereby inform you that the party responsible for processing your personal data is Fundación de la Universidad de Cantabria para el Estudio y la Investigación del Sector Financiero (UCEIF), with CIF G-39. 622.360 and domiciled at Avda. de los Castros 44, Centro Desarrollo Tecnológico Universidad de Cantabria (CDTUC) Fase A – Local 108- 111, 39005 Santander (Cantabria). We also inform you that you must sign the Informed Consent on Data Protection that you will find in the online form, in order to authorise UCEIF Foundation to process your personal data for the purposes set out therein.

COMPLAINTS AND CLAIMS FORMS

UCEIF shall provide students with Complaint Forms in the official format.

LAW

1.- Spanish law is applicable to the purchase of training services available on the website.

2.- Where students do not have the consideration of consumers or users, they and Formación Jurídica, waive their rights to any other jurisdiction, and submit to the courts and tribunals of Santander (Spain).
